Terms and Conditions

1. INTRODUCTION

These Terms and Conditions (“Terms”) govern your use of SST Performance Cloud Services (“Services”), which are provisioned through Sangfor Cloud infrastructure and physically hosted within Equinix UAE Data Centers. By accessing or using our Services, you agree to comply with these Terms.

2. SERVICE OVERVIEW

SST provides Infrastructure-as-a-Service (IaaS), Backup, Virtual Private Servers (VPS), Virtual Networks, and optional managed services.
Services are delivered using Sangfor HCI & Cloud Platform and physically hosted in Equinix UAE, ensuring high reliability, availability, and data sovereignty.

3. ACCOUNT & AUTHORIZED USE

Customers are responsible for account access and securing credentials.
Services must not be used for illegal, abusive, or unauthorized activities.
SST reserves the right to suspend services if misuse, security threats, or policy violations occur.

4. INFRASTRUCTURE & DATA CENTER SECURITY

SST infrastructure is hosted in Equinix UAE, a Tier-III+/Tier-IV compliant facility offering:

  • 24/7 on-site security
  • Biometric access control
  • Redundant power and cooling systems

SST does not provide physical access to customer systems without written request and approval.

5. DATA PRIVACY & SOVEREIGNTY

All customer data resides physically in the UAE.
SST complies with UAE data protection laws. Customer data is not transferred outside the country without consent.
Customers maintain full ownership and control of their data.

6. SERVICE AVAILABILITY & SLA

SST guarantees 99.9% uptime per calendar month, excluding planned maintenance or Force Majeure.
Scheduled maintenance notifications will be provided at least 48 hours in advance.

7. BILLING & PAYMENT TERMS

Services are billed monthly or annually based on the selected plan.
Payment is due within 15 days of invoice date.
Late payments may result in service suspension or termination.

8. BACKUP & RECOVERY

Optional backup services are available on request (daily/weekly/monthly).
Default services do not include automatic backups unless explicitly subscribed.
Disaster recovery solutions are available as add-ons.

9. SUPPORT & ESCALATION

SST provides 24/7 support via ticketing, email, and phone.
Priority response times are governed by severity levels (as defined in the SLA).

10. THIRD-PARTY SOFTWARE & LICENSES

Use of licensed third-party software (Windows, cPanel, etc.) is subject to vendor license terms.
Customers must ensure compliance with software licensing applicable to their deployed VMs.

11. TERMINATION & DATA RETENTION

Services may be terminated by either party with 30 days’ notice.
Upon termination, clients have 10 business days to retrieve data.
SST is not liable for data loss after the retention period post-termination.

12. LIMITATION OF LIABILITY

SST’s total liability is limited to 3 months’ service charges.
SST is not liable for indirect damages, including data loss, downtime, or third-party claims.

13. FORCE MAJEURE

SST is not liable for service interruptions due to events beyond its control including:
– Natural disasters, cyberattacks, telecom failure, government restrictions, etc.

14. AMENDMENTS

These Terms may be updated periodically. Any material changes will be communicated via email or portal with 15 days’ notice.

15. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of the United Arab Emirates, and disputes are subject to the jurisdiction of the Abu Dhabi Courts.
